China City Construction isn’t exactly making friends with their new neighbors in Miami Beach.
The developer, which is mostly controlled by the Chinese government, is now facing yet another challenge in court over their proposal to build an 18-story residential tower at 6747 Collins Avenue in North Beach.
On May 19, an attorney for The Sterling Condo Association filed a Petition for Writ of Certiorari demanding that a Dade court overturn Miami Beach Historic Preservation Board Approval to build the project. An individual unit owner has also filed a separate court action.
According to the suit, China City should not have been granted a variance to build a driveway inside of the building’s parking garage that is one foot narrower than permitted by code.
Project architect Arquitectonica had claimed that the narrow driveway was required in order to add condos on the third floor of the project, but The Sterling claims that a variance should be granted only if it is needed to prevent the entire property from becoming unusable.
